Terms of Service

Welcome to SVGs.app ("we," "us," or "our"). These Terms of Service ("Terms") govern your use of our website, services, and applications (collectively, the "Service"). The Service is provided by SZABÓ Z. ÁKOS PERSOANĂ FIZICĂ AUTORIZATĂ, a sole proprietorship registered in Romania with VAT number RO51946845.

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

1. Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

2. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

  • In any way that violates any applicable national or international law or regulation.
  • To generate content that is defamatory, obscene, pornographic, vulgar, offensive, or that promotes discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group.
  • To infringe on the intellectual property rights of others.
  • To reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Service.

3. Content and Ownership

Your Content: You retain ownership of the text prompts and other content you submit to the Service ("Input").

Generated Content: You own the rights to the SVG files and other assets generated by the Service based on your Input ("Generated Content"). If you are a paid subscriber, you are free to use the Generated Content for personal or commercial purposes, subject to these Terms and the terms of any third-party services we use. Users on the free plan are granted a non-exclusive license to use Generated Content for personal, non-commercial purposes only; commercial use requires upgrading to a paid plan.

AI-Generated Content Disclaimer: You acknowledge that Generated Content is created by an artificial intelligence system. The nature of AI means that outputs may not be unique, and other users may receive similar or identical Generated Content. We make no warranty or guarantee as to the uniqueness, accuracy, or suitability of any Generated Content.

License to Us: By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your Input and Generated Content solely for the purposes of operating, providing, and improving the Service. If you choose to publish your Generated Content to the community, you grant us a broader license to publicly display and distribute it.

4. Fees, Payments, and Credits

The Service may be available under free or paid subscription plans. Fees for paid plans are specified on our billing page and are subject to change.

Use of the AI generation features requires "credits." Credits are allocated based on your subscription plan and can be used to generate content. Credits do not have a monetary value, are not redeemable for cash, and may expire at the end of a billing period, as specified in your plan.

All payments are processed by our third-party payment processor, Stripe. We do not store your full credit card information. Payments are non-refundable except where required by law.

5. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or delete your account through the settings page, if available.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

7. Limitation of Liability

IN NO EVENT SHALL SZABÓ Z. ÁKOS PERSOANĂ FIZICĂ AUTORIZATĂ, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

OUR TOTAL LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US, IF ANY, IN THE 12 MONTHS PRECEDING THE CLAIM.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of Romania, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Cluj-Napoca, Romania.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
